  • India is not signatory to UN Convention on Refugees laws both in 1951 and 1967.
  • Thus, there are no specific refugee’s laws in India under which Tibetans are governed in India.
  • Therefore, Tibetans are equivalently treated like those of other foreigners visiting India.
  • The foreigners Registration Act, 1946 and Registration of foreigners rule, 1992 are the two fundamental laws governing Tibetans in India.

  Procedure for registration of RC FOR those Tibetans born in India.

  • Registration to be done after attaining the age 16 u/s 2 of the 1957 Act.
  • Fill online registration system which is recent development.
  • Furnish birth certificate, if not than get affidavit stating birth.
  • Bonafide/support letter from concern TSO.
  • Attach parents RC along.
  • Application dully signed by the applicant.
  • Finger print done on RC booklet.

  1. Procedure for registration of RC who have escaped Tibet into India.
  • Unlike Tibetans who are born in India, Tibetans escaping Tibet into India, they have to furnish Special Entry Permit (SEP) which is being given to Tibetan under recommendation of Tibetan reception centre.
  • Online application dully filled.
  • Bonafide/support letter respective TSO/schools or authority concern.
  • Furnish birth certificate, if not than get affidavit stating birth.
  • Application dully signed by the applicant.
  • Finger print done on RC booklet.
  • Registration age remains same as 16 years.
  1. Procedure when RC registration or renewal is delayed and penalty.

       As per section 2 of the act, everyone has to register at the age 16 years and renew their RC every year     or on 5 years basis.

      Section 5 and 14 of 1939 and 1946 act, those who contravene the said rule will be subjected to imprisonment for terms which may extend up to 5 years or with fine, under complete discretion of the concern FROs.

 Unlike before, on dated 26th September 2016 CTA under notification from the FRO Dharamsala has circulated a notice pertaining to punitive action will be taken in case of Tibetan delaying in their RC registration, which are as follows….

  • If delayed by 1 to 90 days than pay fine of $ 30
  • If delayed by 91 to less than 2 years, fine of $ 130
  • If delayed by 2 years and more, fine of $ 230.
